Campus Consequences

Administrative Procedure AP 3434 Responding to Harassment Based on Sex under Title IX  includes the disciplinary sanctions that may be imposed.

Possible disciplinary sanctions for student Respondents include written or verbal reprimand, required training or counseling, non-academic probation, suspension, and expulsion. Any disciplinary action taken for a student will comply with Board Policy/Administrative Procedure 5520

Possible disciplinary sanctions for employee Respondents include written or verbal reprimand, required training or counseling, demotion, suspension, or discharge. Any disciplinary action taken for an employee will comply with the appropriate Collective Bargaining Agreement

Civil Consequences

Individuals alleged to have committed acts of gender-based harassment and/or sexual misconduct may be subject to civil lawsuits. These lawsuits can seek damages for pain and suffering, medical expenses, and more.

Criminal Consequences

Individuals alleged to have committed acts of gender-based harassment and/or sexual misconduct may be subject to criminal charges. The criminal charges may include rape, sexual battery, and other sex-related crimes. The specific charges depend on the nature of the act and the laws of the state where the incident occurred. If convicted, the individual’s sentence could range from probation to incarceration and the individual may have to register as a sex offender which can severely impact where the individual can live, work, and travel.
